Terms of Service

Welcome to DevMatch! These Terms of Service ("Terms") govern your access to and use of https://dev-match.xyz, our APIs, MCP server, and related services (the "Service").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old and have the legal capacity to enter these Terms. If you use the Service on behalf of a company, you represent that you have authority to bind that company.

2. Accounts

• You may create an account via email magic link or OAuth providers such as GitHub.
• You are responsible for account security and all activity under it.
• We may suspend or terminate accounts that violate these Terms or abuse free-tier credits or rate limits.

3. Description of Service

DevMatch provides tools to discover engineers and technical contributors who uniquely fit based on public work with evidence — including open-source and GitHub contributions, research, aerospace, and defense-related corpora where available — via web search, chat-based discovery, builder profiles, and an MCP server for AI coding assistants. We also offer an optional Placement service: done-for-you sourcing, shortlisting, and outreach against a role you submit.

4. Plans and credits

Platform access is metered with credits. Unless your contract says otherwise:

• Free — 250 credits per month.
• Pro — 350 credits per month, billed at $129/month or $1,290/year.
• Enterprise — credit allowances set in the contract.

Credits are a company-shared pool keyed to your company domain when you belong to a company. Teammates on the same domain draw from the same allowance. If you have no company, credits are metered per user. Credits reset monthly and do not roll over. Abusing credits or rate limits may result in suspension.

Spending credits to reveal a shortlist candidate unlocks that engineer's identity and evidence for your company. Reveal is billed once per company + candidate (re-reveals do not re-bill). Connecting your email (Gmail) unlocks Platform messaging from your mailbox — replies land with you. Placement outreach, when you submit a role for matching, is sent by DevMatch on your behalf until you connect your own mailbox.

5. Platform subscription

Paid Platform plans are billed through Stripe. You may cancel at any time; access continues through the end of the paid period. Taxes may apply. Failed payments may result in downgrade to Free or suspension of paid features.

6. Placement fees

Placement is optional. When you submit a role for matching and accept the fee agreement, you agree that on a confirmed hire of a candidate from our shortlist for that role (or a substantially similar role at your company within a commercially reasonable period), we will charge:

• $10,000 if the posted base-salary midpoint is under $200,000 USD; or
• $15,000 if the posted base-salary midpoint is $200,000 USD or above.

Midpoint means the midpoint of the base range you provide for the role (or the single base figure if you provide one). The fee is due on confirmed hire, not when you submit the role. Submitting a Placement role requires saving a card on file via Stripe ($0 at submit); we use it to bill off-session only on a confirmed hire. A successful hire from our shortlist includes candidates you approved or engaged through the Service (including Slack or Discord review) whom we sourced or introduced for that role.

30-day replacement guarantee. If a placed candidate leaves or is terminated within 30 days of start for reasons other than a change in role, compensation, or company circumstances outside normal performance, we will run a replacement search for the same role at no additional placement fee.

7. Either/or billing

Platform and Placement are not stacked. If you use the Platform path (Free, Pro, or Enterprise) to find and hire someone yourself, we do not charge a placement fee for that hire. If you use Placement, you are not required to hold a Pro subscription; Platform credits still apply if you use chat, directory, or MCP under a Platform plan. We do not charge both a monthly Platform fee and a Placement fee for the same hiring motion.

8. Slack and Discord

Slack and Discord integrations are optional review channels for your company shortlist. Installs are free. Approve/pass actions in those channels are part of the Service and subject to the same Acceptable Use rules. Sending is separate: Platform outreach uses your connected email; Placement outreach is sent by DevMatch. We do not sell your messages. Usage of discovery tools from those surfaces follows your plan's credits.

9. Acceptable Use

You agree not to:

• Use the Service for illegal purposes.
• Scrape or extract data beyond normal use.
• Abuse MCP tools, credits, or rate limits.
• Harass, spam, or harm others — including via outreach we send on your behalf when you misuse the Service.
• Interfere with the Service's operation or security.

10. Disclaimers

The Service is provided "as is." We do not guarantee accuracy of shortlists or contact data, or suitability for any hiring decision. DevMatch is a discovery and optional recruiting-assist tool, not a guarantee of candidate quality or hire outcome.

11. Limitation of Liability

To the maximum extent permitted by law, our total liability shall not exceed the amount you paid us in the 12 months preceding the claim (or $100 if you have not paid us).

Your use is also governed by our Privacy Policy.
